Clinton, you have mentioned to the hosting company as well as to me a few weeks ago, that you plan on hiring a lawyer. Have you done so yet? If not, as one person to another, I would strongly recommend that you do so. I think it would be helpful for you to have some legal guidance at this stage. As noted, I have attempted to resolve and settle this in every manner possible and you have decided to move in a different direction. I can respect your position but feel like you could benefit some legal assistance.
You have a lot of expertise when it comes to intimidation, don't you? What did you used to teach again? Passive Aggressive Techniques? How caring of you to advise Clinton to get legal guidance!

Thank you for your offer but I respectfully decline. I would propose a counter offer which is to kindly follow the instructions of the pre-claim you received from my UK firm Davenport Lyons, and remove this thread entirely. Also remit to me the IP information of both Alexjn and now ADS1 as well.
That counter offer is not acceptable (if it's even an offer rather than just a repetition of your demands). The original offer still stands and nothing more.

You have now changed your mind.

You contacted my host yesterday to say that you'll now be satisfied if I "move the entire thread" to a private area. In return you agree to waive all rights against me and my company, stop the suit in the UK and drop your claim for IP and email information of posters. In that same email you continue your posturing, claiming that you could win legal action, claiming that you've suffered significant damage that you are going to prove in court etc.

If you prefer that I go through the process of getting a court order first than I can appreciate that and will do so
    Go ahead.

I do not have faith you will keep to any of your above undertakings to stop harassing me and the forums if I move the thread. I do not trust you. I do not believe you will lay off and not start threatening legal action again on the slightest pretext. I cannot guarantee that some future poster won't start a thread about you. I refuse to impose a complete ban on ever discussing you or your business in future.

This thread will stay here in the public forums till I'm ordered to remove it by a competent court in a jurisdiction I recognise.

In the months and years ahead if members and non-members alike still see this thread here they will know that either Avid has lost his claim in court ...or he was possibly full of hot air from the start and was maybe atttemping to scare us into removing all discussion of Avid Amiri and Internet Enterprises limited.

I look forward to support from forum members if action does proceed. Though many have made private offers of financial assistance - especially some of Avid's previous customers - I'm okay for money, but thank you. I'll get back on how you can help if this action does proceed.

Gee, if only Avid Amiri (Internet Enterprises) had either left this thread alone, or simply entered it to offer his viewpoint and help to those who felt scammed by him... Now he has painted a picture of himself as someone who gets angry, vengeful, and makes claims he does not follow up on. One might speculate (at his change of heart) if his attorneys ever advised him that he had a winning case here -- or if they just went the "see if a few threatening letters work" route. And, thus, one might speculate what other claims Avid Amiri makes that are not quite accurate.

I am just glad to see Clinton stood strong through this and was not bullied or bribed into weakening this awesome forum!

Perhaps Avid should sue himself, since he's done far worse damage to his own reputation than any of the anonymous accounts here. Of course assuming the person posting with the 'Avid' account is truly him.

Thanks for making me laugh so hard that I spewed Pepsi out my nose and all over my laptop Peter. Expect to hear from my attorney for damages!

Avid's UK legal advisors were informed at the start that this website is owned not by me but by a new limited company set up late last year. However, Avid and his legal advisors seem determined to try and claim compensation from me personally as Avid's been advised that there seems to be no money in the company worth chasing.

Early on I advised his UK legal firm to address correspondence to me as a director of the firm rather than as an individual. They seem to be intentionally ignoring this and even writing to me at my home address in what seems an attempt to intimidate me.

Trying to or threatening to try and pin liability on me personally rather than on the limited company that owns this site is a violation of UK laws on harassment.

That they have attempted to trick me into replying in my personal name rather than as a company director, that threats have been made to claim $1,000,000 in compensation from my personal funds, that a cash offer was made to me personally in an attempt to induce an acceptance that could be taken as evidence that I control this site in my personal name etc., has caused me enormous distress. This leaves them liable to claims for compensation. I have notified them of this by letter.

I may not say any more on this matter of compensation from Davenport Lyons so as not to prejudice my case against them.

Avid has seven days in which to unconditionally accept my previous offer to move offending posts to a members only section of this website as a satisfactory and complete resolution of his grievances.

His acceptance or otherwise has no bearing on my claim against Davenport Lyons.

Today makes seven days since my offer above. Initially I got the impression from this correspondence that he would accept especially after I elaborated in an email on what I was going to do. I thought I had covered it in enough detail. Yesterday he sent me a long email asking what exactly "private forum" meant, how difficult it would be for people to access it, what I'd do if someone else started a new thread about him, what I'd do about existing members who've criticised him etc. etc. I replied that I have neither the time nor the inclination to put together a 600 page manual to cover every possible future contingency and to plan for every hypothetical situation he could come up with.

He also wants me to discuss with him "ideas" on how to address adverse comments he is finding elsewhere on the internet like this blog post which he claims is run by a "colleague" of mine!

I don't have time for this. It's a good faith offer. He either accepts it by the end of business today or ... it lapses and he can go to court.

I was running short of material to post on my blog. But that links gives me an idea, so thanks for that

His arguments are getting silly as well. One of his requests is that I annonymise all the posts by removing his name wherever it occurs and leaving it to the reader to do some digging to find out who the thread is about. Apparently that's something I already do on these boards and he's given me this example where I referred to websiteproperties as "very expensive broker".

I hope I was wrong in my previous post and he just gets back by end of business today to confirm acceptance.
